Anyone who works with the constitution associates this with certain theoretical presuppositions which together lead to a basic understanding of the constitution, a conception of the function of a constitution or a theory of the constitution. The theory of the constitution in this work attempts to reconstruct these presuppositions and to enlarge upon them according to certain uniform classification criteria in order to demonstrate explicity what is constantly happening implicitly. The author deals with the concept of constitution, the claims it makes, the peculiarities of its norms, the manner of its application, the actors involved, the problem of normativity as well as the effects of Europeanization and internationalization. All this culminates in the question of the continuance of the constitution as we know it. The main idea is an interpretation of constitution as a social practice in which a society comes to terms with its central concepts of order and justice.
