This interdisciplinary study assesses the potential for successful cartel damage claims in Germany, the Netherlands and Spain after the implementation of the Antitrust Damages Directive 2014/104/EU. It puts emphasis on the volume effect, a form of lost profit that, as economics confirms, regularly occurs when cartel purchasers pass-on the cartel overcharge.
