With Special Consideration of Killer Acquisitions and the Tenth Amendment to the ARC': This publication deals with existing regulatory gaps within European and German merger control. This includes, for example, the problem of killer acquisitions or the recruitment of founders and employees. To close these gaps, the application of Art. 102 TFEU is examined. The work offers a comprehensive analysis of the applicability of the norm, both with regard to its role in the current system of antitrust law as well as the application of the per se.

Jan-Lukas Henkst studierte von 2013 bis 2019 Rechtswissenschaften und begleitend Europäisches Recht an der Julius-Maximilians-Universität Würzburg. Nach Beendigung seines Studiums mit der Ersten Juristischen Prüfung und des Abschlusses als Europajurist (Univ. Würzburg) folgte die Aufnahme des Promotionsstudiums am Lehrstuhl für globales Wirtschaftsrecht, internationale Schiedsgerichtsbarkeit und Bürgerliches Recht von Prof. Dr. Florian Bien, Maître en Droit (Aix-Marseille III). Promotionsbegleitend war er bei verschiedenen Rechtsanwaltskanzleien in Düsseldorf als wissenschaftlicher Mitarbeiter tätig. Sein Referendariat absolvierte er von 2022 bis 2024 am Oberlandesgericht Düsseldorf, unter anderem mit Station beim Bundeskartellamt.
