Pilotage alongside the access channels to Mozambican ports, as well as in berthing/departing maneuvers is compulsory in Mozambique for merchant vessels; this means that in certain navigation moments the ship Captain shall entrust the effective command of his ship to a person outside his crew during these movements. Additionally, in conducting maneuvers within the Mozambican port waters the ship is normally assisted by tugboats also driven by someone strange to the ship crew. It can happen, as often happens, that while under pilotage and/or assistance of tugboats the ship sustains herself, or causes damages to third parties. Who is liable for such damages?
